Are the Menéndez brothers getting released?

The success of Netflix hit Monsters: The Lyle and Eric Menéndez Story may soon have real-life implications for the sibling duo at the centre of its story.

From Netflix to reality

Helmed by American Horror Story creator Ryan Murphy, this nine-part series chronicled the murder of José and Kitty Menéndez by their young sons Erik and Lyle. 

Based on real events

The pair claimed that the murders were the result of years of sexual abuse at the hands of their father, José. After an initial mistrial, the brothers were ultimately sentenced to life imprisonment without the possibility of parole in 1996.

Life without parole

However, all that could change after a Los Angeles District Attorney filed a petition last week to resentence the duo to 50 years to life on two counts of first-degree murder.

If this goes ahead, the pair will be eligible for youth parole under Californian law, as they were both under the age of 26 at the time of their crime and have already served 30 years in prison.

This change follows the brothers' attorneys submitting new evidence relating to the abuse they claim to have suffered. According to a recent news conference, the petition is set to go before a judge between the next 30 - 45 days.
